Draft of Industrial Relation (Karnataka) Rules, 2021

The Draft Rules of Karnataka for the Industrial Relations Code (“Draft Rules”) has been notified in the gazette on 03 May 2021.

Applicability

The Draft Rules upon coming into force shall extend to the State of Karnataka and they shall come into force on the date of their final publication in the Official Gazette.

  • Form I – Written Agreement between the employer and workers arrived at otherwise than in the course of conciliation proceeding [Rule 3]
  • Form II – Manner of filling Application under section 4(8) for the Conciliation of grievance as against the decision of the Grievance Redressal Committee [Rule 7]
  • Form III – Auditor’s Declaration [Rule 9(7)]
  • Form IV – Notice of Dissolution or Amendment in Rules of a Trade Union [Rule 10]
  • Form V - Application for Registration of Trade Union [Rule 11(1)]
  • Form VI – Affidavit to attach with Application [Rule 11(2)]
  • Form VII – Applicants duly authorized to make application on behalf of Trade Union [Rule 11(3)]
  • Form VIII – Register of Trade Unions [Rule 11(5)
  • Form IX - Certificate of Registration [Rule 12]
  • Form X – Request to withdraw or cancel Certificate of Registration [Rule 11(8)]
  • Form XI – Notice of change of name [Rule 13(5)]
  • Form XII – Application for declaring the Trade Union as the Negotiating Union or Member of the Negotiating Council [Rule 14(3) & (4)
  • Form XIII – Register of Negotiating Union or Member of the Negotiating Council [Rule 14(6)]
  • Form XIV – Notice of Amalgamation of Trade Unions [Rule 20(1)]
  • Form XV – Notice of Change of Name [Rule 20(3)]
  • Form XVI – General Statement prescribed under section 26 of the Code [Rule 22(1)]
  • Form XVII – Application for Recognition of State Level Trade Union [Rule 23(1)]
  • Form XVIII - Notice of change of service conditions proposed by an employer) [Rule 33]
  • Form XIX - Agreement for voluntary arbitration [Rule 34(1)]
  • Form XX - Authorization by a worker, group of workers, employer, group of employers to be represented in a proceeding before the authority under this Code [Rule 36]
  • Form XXI - Form of Oath of Office for Judicial Member of State Industrial Tribunal [Rule 37 (21)]
  • Form XXII – Form of Oath of Office for Administrative Member of State Industrial Tribunal [Rule 38(21)
  • Form XXIII - Application to be submitted before the Tribunal in the matter not settled by the Conciliation Officer [Rule 39(5)]
  • Form XXIV - Notice of Strike to be given by Union (Name of Union)/ Group of Workers [Rule 40]
  • Form XXV - Notice of Lock-out to be given by an employer of an industrial establishment [Rule 41(1)]
  • Form XXVI - Notice of Intimation of Retrenchment to be given by an employer to the Government [Rule 42]
  • Form XXVII - Notice of Intimation of Closure to be given by an employer to the Government [Rule 44]
  • Form XXVIII – Form of Application for permission of Lay-off in Industrial establishment /Undertaking to which provisions of Chapter X of the Code applies [Rule 45]
  • Form XXIX – Form of Application for permission of Retrenchment in Industrial establishment /Undertaking to which provisions of Chapter X of the Code applies [Rule 48]
  • Form XXX – Form of Application for permission of Closure in Industrial establishment / Undertaking to which provisions of Chapter X of the Code applies [Rule 50]
  • Form XXXI - Notice to the Employer who committed an offence for the first time under this code, for compounding of offence under section 89(4) [Rule 54]
  • Form XXXII - Complaint under Section 91 of the Code [Rule 56(1)]
  • Form XXXIII – Manner of authorization of worker for representation under section 94 of the Code [Rule 57]
  • Form XXXIV – Manner of authorization of employer for representation under section 94 of the Code [rule 58]
