ESIC clarifies Aadhar not a mandate to claim benefits

ESIC has clarified that the insured persons under the ESI Act shall not be denied any benefit for the want of Aadhar.

ESIC vide circular no. P-11/14/11/Rules/2020-BFt II dated 20 May 2021, has clarified that the insured persons under the ESI Act shall not be denied any benefit for the want of Aadhar.

The Central Government has notified that Section 142 of the Code on Social Security, 2020 shall be effective from 03 May 2021. In order to invoke this provision, the authorities shall establish the identity through Aadhar of the employees or unorganized workers or any other person, for self or dependants to avail services, seek benefits, receive payments, etc. under the Code, rules, regulations and/or schemes framed under it.

Although the above-mentioned section has been brought to effect, other provisions of the Code including the provisions related to ESI schemes/benefits, etc. are yet to be implemented.

Hence ESI affirmed that the insured persons’ claims and benefits under the ESI Act shall not be denied for the aforesaid reasons.
