Clarification for Certificate for Unpaid Amount of Gratuity by Employer

In order to clarify the query raised on seeking interpretation of Gratuity Recovery under Section 8 of the Act, the Gujarat Labour Department issued a circular.

It has been clarified that under Section 8 of the Act, 'that amount' means the amount of gratuity payable under the Act by the employer to the person entitled and the controlling authority is required to issue a certificate in regard to the unpaid amount only.

The Controlling authority is required to give the employer a reasonable opportunity of showing cause against the issue of such certificate and while recovering the unpaid amount along with the compound interest.
