Third Party Certification Scheme under Puducherry S&E Act, 1964
The Government of Puducherry has published notification regarding Third Party Certification Scheme under Puducherry S&E Act.
Objective of the Scheme
- Simplifies business regulations and reduces compliance burden.
- Allows establishments to demonstrate compliance with labour laws through Third Party Certification.
- Covers several laws, including:
- Puducherry Shops and Establishments Act, 1964
- Minimum Wages Act, 1948
- Payment of Wages Act, 1936
- Contract Labour (Regulation and Abolition) Act, 1970
- Inter-State Migrant Workmen Act, 1979
- Payment of Bonus Act, 1965
- Payment of Gratuity Act, 1972
- Maternity Benefit Act, 1961
- Equal Remuneration Act, 1976, and others
Scope Employers registered under the Puducherry Shops and Establishments Act, 1964 are eligible to opt for the Scheme.
Audit & Reporting
- Annual audit to be conducted in April of every year.
- Auditor to submit Audit Report to the head of establishment and Labour Department.
- Establishments must submit Action Taken Report along with proof of compliance.
- Compliance certificates must be uploaded to the online labour portal (https://labour.py.gov.in/) by 30th April for the previous financial year.
Annexure (Form-I) Provides the Certification Format for Third Party Inspectors/Auditors. Two options:
- Certifying full compliance with all labour laws, or
- Certifying compliance except for specific deviations (which must be listed)
This scheme empowers establishments in Puducherry to comply with multiple labour laws through Third Party Certification by independent professionals, thereby reducing regulatory burden while ensuring accountability through annual audits and online compliance reporting.
