Applicability Threshold
The Act now applies only to establishments employing 20 or more persons.
Revised Working Hour Provisions
- Daily working hours increased from 8.5 to 10 hours.
- Maximum daily span (including overtime) raised to 12 hours.
- Overtime limit revised to 144 hours per quarter.
- A “quarter” is defined as a 3-month period starting Jan, Apr, Jul, or Oct.
- Break duration updated to 30 minutes to 1 hour, with total duty capped at 12.5 hours.
Special Provisions for Women Employees
Women may work in any shift/day but post-8 PM to pre-6 AM shifts require:
- Written consent
- Adequate workplace safeguards, including:
- Restrooms and ladies’ toilets
- Transport arrangements to doorstep
- CCTV surveillance
- Harassment protection measures
Young Persons' Restriction
No young person shall be allowed to work after 8 PM.
Immediate Actions for Compliance by the HR teams will be:
- Review and update shift rosters, attendance, and overtime policies.
- Ensure documentation of consent from lactating or pregnant employees working overtime.
- Conduct infrastructure checks for compliance with safety requirements.
Admin/Facilities to:
Validate availability of restrooms, CCTV, and secure transport facilities.
Supervisors to:
Communicate policy updates to teams and ensure shift schedules are compliant.
